While some outsourcing activities are fairly straightforward, those involving global outsourcing of business processes and critical applications, such as HR administration or finance and accounting, can be very complex, involving a host of legal and tax issues ranging from the labor rights of affected employees and the creation of tax-efficient strategies and structures, to improving internal data protection and privacy controls and updating financial accounting and corporate compliance control systems to accommodate third-party involvement. Cutting across all of these issues is also the complex question of whether - as between the parties - the sourcing provider or the customer should bear primary responsibility for identifying and ensuring compliance with legal requirements that are often overlooked.
